These Keywix.cloud Terms of Use (‘Terms’) constitute a binding and enforceable legal contract between Keywix Pty Ltd (‘Keywix’, ‘we’, ‘us’ or ‘our’) and you, the user (‘User’, or ‘you’), in relation to the use of Keywix.cloud website, mobile application or any other services, applications and features offered by Keywix (collectively, the ‘Keywix Services’).
By accessing or using the Keywix Services, you agree to be bound by these Terms and our Privacy Policy<add link here>, which is incorporated herein by reference. If you do not agree to these Terms, you much immediately discontinue your use of the Keywix Services.
To use the Keywix Services, you mush be at least 13 years of age and have a legal capacity to enter into a binding contract. If you are under 13 years old or do not have the legal capacity to enter intro a contract, you may not user the Keywix Services.
In order to access and use certain Keywix Services, you may be required to create a user account (‘User Account’). When creating a User Account, you must provide accurate and complete information.
You may use the Keywix Services solely for your personal or commercial use. You agree not to use the Keywix Services for any unlawful or prohibited purpose. This includes, but is not limited to, using the Keywix Services to:
The Keywix Services, including all content, features, and functionality, are owned by Keywix and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. You may not modify, copy, distribute, transmit, display, reproduce, or create derivative works from the Keywix Services.
The Keywix Services may contain links or integrations to third-party websites, applications, or services. Keywix is not responsible for the availability, content, or privacy practices of those third-party services. Your use of third-party services is at your own risk and subject to the terms and conditions of those services.
Keywix reserves the right to suspend or terminate your access to the Keywix Services at any time, for any reason, including if Keywix reasonably believes that you have violated these Terms. You may also delete you User Account at any time. Upon termination, you right to use the Keywix Services will immediately cease.
These Keywix Services are provided ‘as is’ and ‘as available’ without warranties of any kind, either express or implied. Keywix does not warrant that the Keywix Services will be uninterrupted or error-free, or that any defects will be corrected. Keywix disclaims all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
In no event shall Keywix be liable for any indirect, special, incidental, or consequential damages related to your use of the Keywix Services, even if Keywix has been advised of the possibility of such damages. Keywix’s total liability to you for all claims shall not exceed A$ 1.
Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of Victoria, Australia, without giving effect to any principles of conflicts of law. Any disputes arising out of or related to these Terms or the Keywix Services shall be resolved exclusively in the courts of Victoria, Australia.
Keywix reserves the right to modify these Terms at any time. If we make changes, we will post the revised Terms on the Keywix.cloud website and update the ‘Last Revised’ date at the top of this document. Your continued use of the Keywix Services after the revised Terms have been posted will contitue your acceptance of the changes.
